ORDINANCE NO: 1428

 

AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF OSWEGO, KANSAS, AMENDING THE CITY CODE OF THE CITY OF OSWEGO, KANSAS, CHAPTER XI. PUBLIC OFFENSE, ARTICLE 2. LOCAL REGULATIONS, ESTABLISHING NEW SECTION 11-213, FOR PROHIBITING THE DISCHARGE OF DIRT, WASTE, GRASS CLIPPINGS AND OTHER LAWN DEBRIS WITHIN THE CITY OF OSWEGO, KANSAS.

 

WHEREAS, Oswego City Code,Chapter XI. Public Offenses, Article 2. Local Regulations,Section 11-213, as adopted by the City Council, establishes rules regarding the discharge of dirt, waste, grass clippings and other lawn debris on public roadways.

 

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF OSWEGO, KANSAS.

 

            SECTION l: Oswego City Code ChapterXI. Public Offenses, Article 2 Local Regulations,shall be amended as follows:

 

            SECTION 11-213. It shall be unlawful for any person to throw, cause, rake, place or cause to be deposited, any trees,branches,leaves, grass clippings, dirt, or waste into the street, gutter or curb of any public street. No person shall permit grass clippings from mower swaths to remain upon city streets, gutters or curbs of any public roadways,or on abutting property, not owned or occupied by said person.

 

            A first offense shall be a warning from the Police Department. Second and subsequent violations of this code shall be subject to punishment by a fine of not less than $10.00 nor more than $50.00.

 

            SECTION 2:All ordinances,resolutions or policies or parts thereof in conflict here with are hereby expressly repealed insofar as they conflict herewith.

 

            SECTION 3:This ordinance shall take effect and be in force from and after passage and publication in the official city newspaper.

 

            SECTION 4: Court Costs are waived for all violations.

 

            PASSED and APPROVED by the Governing body this 15th day of October, 2019.
