ORDINANCE NO. 1342
AN ORDINANCE GRANTING A CONDITIONAL USE PERMIT TO ALLOW A VETERINARY BUSINESS ON RESIDENTIALLY ZONED (R1-A) PROPERTY WITHIN THE CITY LIMITS AT 2269 13000 ROAD, OSWEGO, LABETTE COUNTY, KANSAS.
WHEREAS, application has been made by the city requesting a conditional use permit to permit a veterinary business on a residential zoned property after annexing said property into the city limits – 2269 13000 Road, Oswego, Kansas; and,
WHEREAS, the Oswego Planning Commission of Oswego, Kansas conducted a public hearing on Case No. CUP 2015-01, following published notification in accordance with K.S.A. 12-741, et. seq., as amended, on February 11, 2015; and
WHEREAS, the Oswego Planning Commission based on information presented and discussed at the hearing, has recommended that the Governing Body of the City of Oswego, Kansas, approve the Conditional Use Permit to allow a veterinary business on a residential zoned property at 2269 13000 Road, Oswego, Kansas, be approved;
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF OSWEGO, KANSAS, THAT:
Section 1. The following described property is hereby granted a Conditional Use Permit allowing the veterinary business on a residential zoned lot at 2269 13000 Road:
Beginning at a point where the right of way of the main line of the MKT railroad
Intersects the North line of the NE ¼, Sect. 17, Twp. 33, Range 21, then East
666 2/3 feet, then South 666 2/3 feet, then West 293 feet to the right of way of
MKT railroad then North along the right of way to point of beginning, except ROW.
Section 2. That this ordinance shall be in full force and effect upon its passage and publication in the official city newspaper.
PASSED AND ADOPTED THIS 13th day of April, 2015 by the Governing Body of the City of Oswego, Kansas.
