Shanholtzer- $40.37, Kent Vanderpool- $12.64 and Cheryl Wilkerson- $0.28 have unclaimed utility deposits with the utility department of the City of Oswego and may claim said utility deposits. ORDINANCE NO. _1444_

An Ordinance authorizing and adopting procedures whereby those persons, who have unclaimed utility deposits with the utility department of the City of Oswego may claim said utility deposits; establishing a rate of interest to be paid on said utility deposits when claimed; and providing for disposition of utility deposits that remain unclaimed.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF OSWEGO, KANSAS:

SECTION 1. That the persons listed in “Attachment 1” received utility service provided by the Utility Department of the City of Oswego in the past. That said persons placed a utility deposit with the Utility Department of the City of Oswego and said utility deposit has been held by said municipal utility for a period of more than three (3) years from the date that utility service to said persons was discontinued. That no demand for such refund of such utility deposits has been made during the three (3) year period and the addresses of the persons whom refunds are due remain unknown after diligent effort has been made to determine the same. The persons listed in “Attachment 1” have unclaimed utility deposits for water service with the City of Oswego.

SECTION 2. That said persons shall be notified of the unclaimed utility deposit by publication of this ordinance once each week for two (2) consecutive weeks in the official city newspaper. Demand for refund must be made by said persons within 60 days after the last publication of this ordinance. That any utility deposit remaining unclaimed 60 days after the last publication of such notice, shall be forfeited to the operating fund of the Water Department of the City of Oswego, Kansas.

SECTION 3. That all persons desiring to claim a refund of a utility deposit shall contact the Utility Department, City of Oswego, 703 Fifth Street, P.O. Box 210, Oswego, KS 67356, (620)795-4433.

SECTION 4. Refunds of utility deposits shall include simple interest to be paid on the amount of the utility deposit at the annual rate of interest established annually by the Kansas Corporation Commission.

SECTION 5. Any refunds not timely claimed will be placed into the operating fund of the City of Oswego without further notice.

This Ordinance shall take effect and be in force from and after its publication for two consecutive weeks in the official city newspaper.
