Ordinance No. 1451 Summary
On January 11, 2021, the City of Oswego, Kansas, adopted Ordinance No. 1451 approving a conditional use permit in accordance with Section 21 of Oswego Zoning Regulations, allowing for William Trotnic to build a residential home, using a shipping container, with restrictions, at 511 1st St., Oswego, Kansas. ORDINANCE NO. _1451_
AN ORDINANCE IN COMPLIANCE WITH SECTION 21 OF THE ZONING REGULATIONS AND PROVIDING FOR A CONDITIONAL USE PERMIT FOR WILLIAM TROTNIC AT 511 1ST ST. IN OSWEGO, KANSAS.
WHEREAS, the Oswego Planning Commission of the City of Oswego, Kansas received a request for a conditional use permit signed by William E. Trotnic, requesting that the following land, to wit:
W 115’ OF LOT 6, BLOCK 2, CITY OF OSWEGO, LABETTE COUNTY,
KANSAS. PARCEL 115-16-0-40-02-006.
be permitted to allow for a residential home built using a shipping container, with the required restrictions in order to conform to the regulations as set out in Ordinance No. 1398, and;
WHEREAS, the Oswego Planning Commission of the City of Oswego, Kansas did cause notice to be given to all of the property owners of record who own property within 200 feet of the above described property within the city limits; and did cause notice to be published in the official city newspaper of the meeting of the Oswego Planning Commission to consider said zoning request, and;
WHEREAS, the Oswego Planning Commission did at its meeting of January 4, 2021, recommend approval of the conditional use permit.
BE IT THEREFORE ORDAINED BY THE GOVERNING BODY OF THE CITY OF OSWEGO, KANSAS:
SECTION 1. That upon recommendation of the Oswego Planning Commission at a duly noticed meeting thereof, the following described real estate, to wit:
W 115’ OF LOT 6, BLOCK 2, CITY OF OSWEGO, LABETTE COUNTY,
KANSAS. PARCEL 115-16-0-40-02-006.
is hereby approved for a conditional use permit to build a residential home using a shipping container, with the required restrictions in order to conform to the current zoning regulations as set out in Ordinance No. 1398.
SECTION 2. Other conditions as part of the conditional use permit include the house must be inspected by city code enforcement officer(s) during the construction process and can halt construction if construction is not in compliance with Ordinance 1398 regulations. The permanent foundation must meet specifications agreed to by the City of Oswego, Kansas.
SECTION 3. No change is made in the Zoning Ordinance of the City of Oswego, Kansas.
SECTION 4. That the Mayor be authorized to execute all documents necessary to effectuate this change.
SECTION 5. This ordinance shall take effect upon its passage and publication in the official City newspaper.
ADOPTED by the Governing Body and approved by the Mayor of the City of Oswego, Kansas,
this 11th day of January, 2021.
