ORDINANCE NO. 1469

 

AN ORDINANCE AMENDING THE CODE OF THE CITY OF OSWEGO, KANSAS, AND REPEALING ORDINANCE NO. 1339, 1340 AND 1421, RELATING TO: (1) MAINTENANCE, MANAGEMENT, CONDUCT AND CONTROL OF THE SEWER UTILITY OF SAID CITY OF OSWEGO BY AMENDING SECTION 15-334 OF SAID CODE RELATING TO THE RATES CHARGED CONSUMERS IN SAID CITY, (2) REMOVAL AND DISPOSAL OF REFUSE IN SAID CITY OF OSWEGO AND THE OPERATION OF A MUNICIPAL REFUSE SYSTEM BY AMENDING EXISTING SECTION 15-415 OF SAID CODE RELATING TO SERVICE FEES TO BE CHARGED FOR THE COLLECTION AND DISPOSAL OF REFUSE IN SAID CITY, AND (3) THE MAINTENANCE, MANAGEMENT, CONDUCT AND CONTROL OF THE WATER UTILITY OF SAID CITY OF OSWEGO BY AMENDING SECTION 15-222 OF SAID CODE RELATING TO THE RATES CHARGED CONSUMERS AND RURAL WATER DISTRICTS SERVED BY SAID CITY.

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF OSWEGO, KANSAS:

 

Section 1.  Section 15-334 of the Code of the City of Oswego, Kansas is hereby amended to read as follows, and these rates will become effective on May 17, 2022:

            (a)        The following classes of users and charges to those users are hereby established:

 

Class I.  Residential Users - Inside City Limits Single Family Contributors

(1)        1,000 gallons or less of water usage per month - $24.13

(2)        Usage for over 1,000 gallons of water per month will be $1.87 per 1,000 gallons of water used.  Usage shall be determined by the average water usage for the preceding months of January, February and March.  If the user has not established an average water usage in the preceding months of January, February and March, they shall be charged based on 1,000 gallons usage for the first three months of their account activity.  Their sewer charge will then be based upon their first three months of water usage until the next averaging time frame begins.

Class II.  Residential Users - Inside City Limits Multi-Family Contributors

(1)        For duplexes and single family residences sharing the same water meter, there shall be established a separate rate of $24.13 per month per household unit.

(2)        For multi-family units, (apartments, mobile home parks, senior citizen housing, etc.) the total amount of water used each month will be broken down into an amount equal to the city’s average residential water usage (5,000 gallons) to determine the number of equivalent household units, which will be charged at $24.13 per month for each equivalent household unit.

 

Class III.  Residential Users - Outside City Limits Single Family Contributors

(1)        1,000 gallons or less of water usage per month - $36.19

(2)        Usage for over 1,000 gallons of water per month will be $2.84 per 1,000 gallons of water used.  Usage shall be determined by the average water usage for the preceding months of January, February and March. If the user has not established an average water usage in the preceding months of January, February and March, they shall be charged based on 1,000 gallons usage for the first three months of their account activity.  Their sewer charge will then be based upon their first three months of water usage until the next averaging time frame begins.

 

Class IV.  Commercial/Industrial Users.

(1)        1,000 gallons or less of water usage per month - $24.13

(2)        Usage for over 1,000 gallons of water per month will be $2.97 per 1,000 gallons up to and including 11,000; and then $3.94 per thousand gallons for each 1,000 gallons thereafter.

 

Class V.  Commercial Multiple User Contributors.

(1)        For multiple user contributors, (inmate facilities, hospitals, nursing homes, etc.) the total amount of water used each month will be broken down into an amount equal to the city’s average residential water usage (5,000 gallons) to determine the number of equivalent household units, which will be charged at $24.13 per month for each equivalent household unit.

 

Class VI.  Schools.

(1)        1,000 gallons or less of water usage per month - $24.13

(2)        Usage for over 1,000 gallons of water per month will be $2.97 per 1,000 gallons up to and including 11,000; and then $3.94 per thousand gallons for each 1,000 gallons thereafter.

(b)        If a non-residential contributor uses water in a manner in which it is not returned to the wastewater collection and treatment system, the monthly sewer user charge for that contributor may be based on a wastewater meter or separate water meter.  The meter must be installed and maintained at the owner’s expense, in a manner acceptable to the city.  The meter shall be open and available for inspection and reading by an authorized city representative.

                        (c)        Service connection fees; city.  A service fee of $50 shall be charged to all persons, firms or corporations who are located within the city limits and are applying for a new sewer service connection under this ordinance.

                        (d)       Service connection fees; rural.  A service fee of $350 shall be charged to all persons, firms or corporations who are located outside of the city limits and are applying for a new sewer service connection under this ordinance.

 

Section 2.   Existing Section 15-415 of the Code of the City of Oswego, Kansas is hereby amended to read as follows, and these rates will become effective on May 17, 2022:

Sanitation service shall be rendered to residents, businesses and public entities of the city for the following charges to be paid monthly to the city as herein provided:

 

(a) Residential.  Each single family residence or residential unit for collection and disposal of refuse:

Street pick-up, once a week - $15.81

Carry out service, once a week - $19.10

            Persons with more than one poly-cart, shall be charged the full rate per poly-cart. 

 

(b) Sanitation service shall be rendered to commercial and business establishments, for the collection of trash only, (1-95 gallon poly-cart) at the following rates; based on frequency of collection and compressed volume less than 1/2 cubic yard:

Once a week - $18.80

Twice a week - $27.91

Three times a week - $37.03

Four times a week - $46.14

Daily - $55.26

 

(c) For collection of refuse from commercial or business establishments, poly-cart service (2-95 gallon carts), based on frequency of collection, and compressed volume less than 1 cubic yard:

Once a week - $33.11

Twice a week - $48.87

Three times a week - $64.63

Four times a week - $80.39

Daily - $96.15

Dumpsters shall be required at any location if refuse exceeds the volume of two poly-carts on a regular basis.

 

(d) For collection of refuse from homes where a home occupation is located the residence will be charged one-half of the normal residential rate, and in addition they will be charged the appropriate commercial rate based on the rates set out in (b) (c) and/or (e).

 

(e) For collection of refuse from commercial or business establishments, dumpster service, rates are based on frequency of collection, compressed volume, and number of dumpsters. Rates below are established for the first dumpster at 100% and for each additional dumpster at 50% of the rates listed below.

(f) In exceptional cases due to unusual circumstances, or due to the character of the thing or things to be removed, special rates applicable to the collection of trash or refuse from such premises may be established by the city council for sanitation service.

 

(g) Sanitation service may be furnished, at the discretion of the city superintendent in each instance, to persons residing outside the city limits, to whom the city furnishes water, or who reside along the direct route followed by the truck or trucks carrying refuse to the landfill, once weekly, at the monthly rate of $21.17.

 

(h) Sanitation service may be furnished, at the discretion of the city superintendent in each instance, to commercial establishments outside the city limits, to whom the city furnishes water, or who reside along the direct route followed by the truck or trucks carrying refuse to the landfill, once weekly, at 150% of the charges set out for commercial customers as stated in Section 1 (b), (c) and (e).  Home occupations located within a residence outside of the city, would be 150% of the charges set out for home occupations under Section (d).

 

(i) The city may make such changes, from time to time, in the rates and charges for the sanitation service as may be necessary or desirable to defray the expenses of providing and improving the service to the inhabitants of the city.

 

(j) Persons over the age of 65, or those with a disability which does not allow them to carry the refuse to the street, may apply for a waiver through the City Clerk.  They must provide a doctor’s certification stating they are physically unable to carry their trash to the street, and if necessary, must show proof they are financially unable to pay the additional fee for pickup at their residence, rather than taking it to the street.  Those meeting both criteria will receive pickup at their residence for the same fee as the once a week pickup at the street, $15.81.

 

(k) All residents shall utilize city issued poly-carts, including refuse from any home occupation that is conducted at their home.

 

(l)  All commercial operations shall utilize either city issued poly-carts or city issued dumpsters, based on the amount of refuse generated on a regular basis.  The city has the right to upgrade the number of poly-carts or size of dumpster(s) needed, if refuse exceeds what the current containers can hold when it has occurred more than two consecutive weeks.

 

Section 3.   Section 15-222 of the Code of the City of Oswego, Kansas is hereby amended to read as follows, and these rates will become effective on May 17, 2022:

(a) The following schedule of rates shall be charged to all residential consumers within the city limits of Oswego:

The first 1,000 gallons or any fraction thereof is $28.63; and each additional 1,000 gallons consumed is $11.39 per 1,000 gallons.  The minimum charge under this schedule is $28.63.

(b) The following schedule of rates shall be charged to all Commercial A & B consumers (those with ¾” and 1” meters) within the city limits of Oswego:

The first 1,000 gallons or any fraction thereof is $28.63; and each additional 1,000 gallons consumed is $11.39 per 1,000 gallons.  The minimum charge under this schedule is $28.63.

(c) The following schedule of rates shall be charged to all Commercial C & D consumers (those with 2” and larger meters) within the city limits of Oswego:

The first 1,000 gallons or any fraction thereof is $28.63; and each additional 1,000 gallons consumed is $10.60 per 1,000 gallons.  The minimum charge under this schedule is $28.63.

(d) The following schedule of rates shall be charged to all consumers outside the city limits of Oswego, except rural water districts:

The first 1,000 gallons or fraction thereof $57.27; and each additional 1,000 gallons consumed is $22.79 per 1,000 gallons.  The minimum charge under this schedule is $57.27.                                                     

(e) The following schedule of rates shall be charged to all rural water districts obtaining water from the city:

            $11.86 per 1,000 for each 1,000 gallons.

 

Section 4.  That these rates will be automatically increased by 3% each year effective on the beginning date of the February billing cycle expiring in 2027 with the Governing Body reviewing  any changes, increasing or eliminating increase, to the percentage every December during this period.

 

Section 5.  This ordinance shall take effect and be in force from and after its passage, approval and publication in the Labette Avenue. 

 

Adopted by the Governing Body and approved by the Mayor of the City of Oswego, Kansas, this 9th day of May, 2022.
